These Terms of Service ("Terms") govern your access to and use of the Kyni SEO platform and related services (the "Service") operated by Kyni, Inc. ("Kyni," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for losses resulting from unauthorized use of your account where you have failed to take reasonable precautions.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to generate content that is unlawful, defamatory, fraudulent, or harmful; to violate any third-party intellectual property rights; to attempt to gain unauthorized access to the Service or its infrastructure; or to engage in any activity that interferes with the normal operation of the Service.
Access to certain features of the Service requires a paid subscription. Subscription fees are billed monthly in advance. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing cycle, and you retain access through the end of the period you have paid for.
We do not offer pro-rated refunds for partial-month usage, unused credits, or plan downgrades. Refunds are considered on a case-by-case basis only for billing errors (such as duplicate charges) and technical incidents that prevented the Service from functioning for a measurable period. We reserve the right to change pricing with reasonable notice. Price changes apply to subsequent billing cycles; the price you see at signup applies for your current cycle.
The Service uses artificial intelligence to assist in generating content. You acknowledge that AI-generated content may contain inaccuracies and that you are solely responsible for reviewing, editing, and publishing any content before distribution. We make no representations regarding the accuracy, completeness, or suitability of AI-generated content for any particular purpose.
You retain ownership of content you create using the Service, including content generated by AI on your behalf based on your inputs. You grant Kyni a limited license to use your content solely to provide and improve the Service. Kyni retains all rights to the Service itself, including its software, design, and underlying technology.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that specific results will be achieved through its use.
To the maximum extent permitted by applicable law, Kyni shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in courts of competent jurisdiction, as mutually agreed or as required by applicable law.
We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms and updating the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
